1. Who we are

This website (the Site) is operated by Larcin Network (ABN: 49440053254) of Office 3912, Ground Floor, 470 St Kilda Road, Melbourne VIC 3004 (Larcin Network, we, us, our). You can contact us at legal@larcin.net.

2. Acceptance of these terms

By accessing or using the Site, purchasing our products (Products), or interacting with our content (including social accounts), you agree to be bound by these terms (the Terms), our Privacy Policy, and any additional policies referenced on the Site. If you do not agree, you must not use the Site or purchase Products.

3. Eligibility and local laws

The Site is directed to persons located in Australia. If you access the Site from another jurisdiction, you are responsible for compliance with local laws. Our Products may not be available in all locations and may be subject to additional regulatory or shipping restrictions.

4. Independent status; “inspired-by” references; no affiliation

4.1 Independence. Larcin Network is an independent company. We are not affiliated with, endorsed by, or sponsored by any third-party brand or fragrance house.

4.2 Descriptive references. Where we use descriptors such as “inspired by”, “type”, “similar to”, “comparable to”, “dupe”, or equivalent phrasing, these are purely descriptive and intended to communicate an olfactory style or customer-perceived similarity. They do not indicate origin, sponsorship, or endorsement by any third party.

4.3 No counterfeits. Our Products are independently sourced and/or formulated. We do not pass off, re-bottle, or represent third-party fragrances as originals. Packaging, trade names, and get-up are designed to avoid consumer confusion.

5. Third-party intellectual property

5.1 Ownership. All third-party brand names, product names, trade marks, logos, trade dress, bottle shapes, and other indicia remain the property of their respective owners.

5.2 Fair and nominative use. Any reference to third-party marks is for identification/descriptive purposes only to help consumers understand fragrance style. We do not claim any association or ownership.

5.3 No suggestion of endorsement. You must not construe any reference as implying endorsement, sponsorship, or approval by the relevant rights holder.

6. Our intellectual property

6.1 Protected content. Except for Third-Party IP, all content on the Site and in our collateral—including text, copy, product names coined by us, stories, photographs, graphics, artwork, audio-visual materials, packaging designs, logos, icons, layout, code, and compilations (collectively, Larcin Content)—is owned by or licensed to Larcin Network and protected by copyright, trade mark, and other IP laws.

6.2 No licence. Except as expressly permitted, you must not copy, reproduce, adapt, translate, publish, distribute, perform, display, create derivative works from, or otherwise exploit any Larcin Content without our prior written consent.

7. Limited licence to use the Site

Subject to these Terms, we grant you a revocable, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes. You must not: (a) decompile, data-mine, or use automated extraction tools; (b) interfere with security or operation of the Site; (c) frame, mirror, or deep-link without consent; or (d) use the Site to infringe any law or IP rights.

8. User content and feedback

8.1 Your responsibility. If you submit reviews, comments, images, or other materials (User Content), you warrant that you own or control the rights in that User Content and that it is lawful, accurate, and non-infringing.

8.2 Licence you grant. You grant Larcin Network a worldwide, royalty-free, transferable, sub-licensable licence to use, reproduce, adapt, publish, translate, distribute, and display the User Content in any media for marketing or operational purposes.

8.3 Moderation. We may remove or edit User Content at our discretion (for example, if unlawful, misleading, infringing, or offensive).

9. Product and safety information

9.1 Use as directed. Products are for external use only. Avoid contact with eyes, mouth, and broken or irritated skin. Discontinue use if irritation occurs. Keep out of reach of children and pets.

9.2 Allergens & sensitivities. Fragrances may contain potential allergens. Patch-test before use. If you have allergies, pregnancy considerations, or medical concerns, consult a healthcare professional.

9.3 Flammability. Many fragrance products contain alcohol and are flammable. Keep away from heat, sparks, open flames, and hot surfaces. Observe applicable storage and transport rules.

9.4 Regulatory compliance. We endeavour to comply with applicable cosmetic, labelling, and safety requirements in Australia (and any markets we service). Product availability, disclosures, and ingredient information may vary by batch and jurisdiction.

9.5 No medical claims. Products are cosmetic and not intended to diagnose, treat, cure, or prevent any disease.

10. Orders, pricing, and availability (summary)

10.1 Errors and changes. We may correct errors (including pricing/typographical errors) and update availability at any time. An order is accepted when we send a written confirmation.

10.2 Taxes and duties. Prices may be shown inclusive or exclusive of applicable taxes; the checkout will display the final payable amount. International customers (if offered) are responsible for any import duties and local taxes.

10.4 Afterpay/third-party services. If you use third-party payment or financing options, you are subject to their terms in addition to ours.

11. Consumer guarantees (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL) that cannot be lawfully excluded. Where permitted, and to the maximum extent allowed by law, our liability is limited at our option to replacement of goods, supply of equivalent goods, repair, or the cost of doing so.

12. Warranties and liability (to the extent permitted by law)

12.1 As-is. Except for non-excludable rights under the ACL, the Site and Products are provided “as is” and “as available,” and we make no express or implied warranties (including merchantability, fitness for purpose, or non-infringement).

12.2 Limitation. To the fullest extent permitted by law, we exclude liability for any indirect, incidental, special, consequential, exemplary, or punitive loss; loss of profit, revenue, goodwill, or data; or business interruption, arising out of or in connection with the Site, the Products, or these Terms.

12.3 Cap. Where liability cannot be excluded, it is limited to the amount you paid for the Product(s) giving rise to the claim or AUD $100, whichever is greater, subject to your non-excludable rights under the ACL.

13. Indemnity

You indemnify and hold harmless Larcin Network, its officers, employees, contractors, and agents from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your infringement of any IP or other right; or (c) your misuse of the Site or Products.

14. Copyright complaints and takedown process

14.1 Notice. If you believe material on the Site infringes your copyright or other IP rights, please notify us in writing at legal@larcin.net with: (a) identification of the work claimed to be infringed; (b) the URL/location of the allegedly infringing material; (c) your contact details; (d) a statement that you have a good-faith belief the use is not authorised; and (e) a statement that the information is accurate and that you are the rights holder or authorised agent (include an electronic or physical signature).

14.2 Action. We will assess and, where appropriate, remove or restrict access to the material pending review. We may contact the user or content provider for further information.

15. Trade marks, trade dress, and passing off

15.1 Our marks. “Larcin”, “Larcin Network” and any associated logos, product names, and trade dress are our trade marks or unregistered marks. You must not use them without written consent.

15.2 Protection. Unauthorised use likely to cause confusion as to source, affiliation, or endorsement may give rise to claims under trade mark law, passing off, and the ACL (misleading or deceptive conduct).

16. Prohibited conduct

You must not: (a) use any device, software, or routine to interfere with the Site; (b) introduce viruses or harmful code; (c) attempt to gain unauthorised access to accounts, systems, or data; (d) use the Site for unlawful, defamatory, infringing, or fraudulent purposes; (e) copy or scrape Site content for competing purposes; or (f) misrepresent affiliation with Larcin Network.

17. Third-party sites and tools

The Site may link to third-party websites or incorporate third-party tools. We are not responsible for third-party content, terms, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.

18. Privacy

Please refer to our Privacy Policy for information about how we collect, use, disclose, and protect personal information and your rights under Australian privacy law.

19. Suspension and termination

We may suspend or terminate your access to the Site at any time (with or without notice) if we reasonably believe you have breached these Terms or applicable law. Any rights or remedies that have accrued at termination survive.

20. Changes to the Site and these Terms

We may update the Site and these Terms at any time. Changes are effective when posted on the Site with an updated “Last updated” date. Your continued use constitutes acceptance.

21. Governing law and jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in respect of any proceedings arising out of or in connection with the Site, Products, or these Terms.

22. Severability and entire agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed and the remainder will continue in full force. These Terms (together with policies referenced herein) constitute the entire agreement between you and us regarding the Site and Products.
